By purchasing our services, you accept our terms and conditions, and that’s why it’s important that you read them and agree with them. We also invite you to read our data protection policies.

1. Our services.

We are a marketing, design, and internet advertising company, which we provide through the internet for all of Latin America. The following is a brief description of the services.

a. Web design, in which we implement WordPress websites and landing pages. b. Digital advertising with Google AdWords. c. Advertising on social networks and management of business social profiles. d. Technology assistance which are personalized consultations on technological products. e. Marketing strategies in which we analyze your company’s situation and model an action plan. f. Email Marketing, in which we send mass emails to a contact list. g. Content marketing, in which we develop articles that will help your company’s internet positioning. h. Web analytics, which is the analysis of the performance of your advertising and products through Google Analytics. i. Design of logos, banners, cards, and brand identity manuals.

With each of these services come products that you can find in the store or in the quotes, and in whose descriptions you will find the particular conditions that you accept when buying. The entire process begins when you buy.

2. Registrations.

When you purchase any of our services, you must provide us with your name, email address, and in some cases the phone number or WhatsApp, which will be used for purchase follow-up, maintaining direct contact, notifications, and also in sending new promotions. Please read more in our data protection policies.

4. Information delivery.

After payment, a brief will be sent where we request all the information for us to carry out the work. In it, we ask about your tastes, reference frameworks, so that we can deliver work to your liking.

You must provide us with all the information to be able to carry out the different campaigns and designs, any delay in the delivery of information is reflected in the result and therefore we are not responsible for the results or delivery deadlines.

In the process of collecting information, we request a person responsible for attending to us, and who has all the information at hand as agreed. The information must be delivered in a single shipment via email, and the contracted service will be developed once all the information is available.

5. Non-delivery of information

In the case of not receiving information and in order to advance the process, we begin to make progress in the service to deliver a base work which can be approved by you.

In the case of design, if within 2 weeks you have not provided us with any information to work with, then we proceed to complement with filler text and images. Also, if within two weeks a type of design that we have sent as a proposal has not been approved, then we will start with a design of free choice of the agency, with the purpose of showing a base of the work. Once this base is delivered, it will be sent for your approval and to make some modifications. If the deadline for the delivery of information and approvals has passed, any drastic change must be made by the person or company that contracted the service. If you request the change from our work team, then you must pay an additional cost, not exceeding 40% of the contracted service.

In the case of services other than design, if within 1 week the information has not been delivered, then we proceed to develop the respective campaign based on information found on the website or related to the sector, and it will be sent for your approval. If the requested changes are very substantial, then these changes will have an additional cost not exceeding 50% of the contracted service.

6. Additional services.

The contracted services cover exactly what is described on each product page and in the quote, no additional configurations or services are made. Any type of modification is defined in an initial meeting, and such agreements must be registered and accepted by email, and cannot be modified throughout the month.

Text and images that these services require for their elaboration are not part of the contracted services, such as web design and other specific services, and these services must be contracted separately.

In case of additional services, they must be requested in writing to the contact email, and in response we will send you a charge to be able to perform said service.

7. Reviews and modifications

When we deliver any of the services that require a review, such as a website, a catalog, a banner, a book, an advertisement, then any correction will be confirmed by email. These reviews should not exceed more than 3, in case of a higher number, then a value not exceeding 20% additional to the amount agreed at the beginning is charged and according to the contracted service. This applies to each additional review. Any substantive modification with respect to what was initially agreed will have an additional cost not exceeding 50% of what was initially agreed for the service.

You must review all the content in detail, for your approval and correction. This review is available for modification in the first week, with the content you send us. If after that time no notification is received, then the material is published and delivered as it is, not being obliged to make any modification after that first week of review. If in the review and from a lack of delivery of information very drastic changes are requested, then we proceed to charge an additional cost for the development of these changes.

Any management that goes beyond these limits will have an additional cost.

8. Service development and information storage

For the development of web pages in hosting of which we are not owners and therefore do not have control, we first mount it on our own server and after canceling the entire website, we proceed to migrate the site to the owner’s hosting. In the case of the finished website and after one week of the deadline for delivery, then a value of $100,000 will be charged biweekly, payable in advance and that gives you the right to store your site on our servers for a period of 1 to 15 days. This is because we need our servers to manage our work.

9. Free services

When carrying out the campaigns, we implement certain improvements to monitor the performance of the campaigns. If this service is contracted, then said service will be your property, if said service is implemented by us for free, then access to said service will remain with us, unless you buy it separately.

10. Delivery of reports.

All contracted services have a duration of one month, and at the end of the month, reports will be delivered in which the results will be analyzed. No result information is delivered before the end of the month, as it is unformed data, and without prior analysis. In the first month and if the client wishes, weekly reports will be sent on the progress of the campaign. In the following months there will be results reports at the end of the month. If the client requests it, a meeting can be held in the first week after the services have been implemented, to make last-minute changes.

11. Responsibilities.

We are not responsible for false expectations in the results, since these depend on the type of product, the sector, how elaborate the website is, the type of public, the need for the product it offers, the search they do for it, and the competition.

Some services require entering a code on the website. In case it is necessary to enter the code of your website, you must have backups and security copies of the website, in order to restore the information from said copy. We are not responsible for damage caused to the site if you do not have a working backup.

12. Payments

Payments are made with a 50% advance to start and another 50% to deliver, in the case of website design. In case of not paying the other 50% at the time of delivery, a period of 2 weeks will be given to catch up. After this time, we proceed to remove the website from the air and also a penalty of $100,000 pesos until you catch up with the obligations within a period of two more weeks, fulfilling a month in total. If after this month after the page has been delivered, the page has not been paid, then we proceed to auction the website, losing the right to recover its property or any development right related to the project.

In the case of other services, payment must be made in advance. If the payment for other services exceeds $200,000 then a 50% advance can be paid. The other 50% is done once the configurations are made and the service is put into operation, and not subject to waiting for results. In the case of not canceling the other 50% then the campaigns will not be activated.

Regarding payments to third parties, these payments must be made using the credit card of the person contracting the service, and said data remains under the responsibility and management of said sites. We will send you a tutorial on how to proceed with the payments. In case of having paid for the service but not being able to advance with the campaign due to non-payment to third parties, and if within 1 week said payment is not made, then we proceed to cancel the service without the right to refunds.

13. Termination of contract and disbursements

The contract will be suspended for failure to deliver the information and for non-payment of obligations, according to the terms established in these service conditions and within the mentioned deadlines, and no refunds are made.

In case we do not meet the conditions and characteristics of the product specified in the product description, the client must show the documents where these characteristics were requested and promised, and demand their fulfillment. In case of not being able to comply with it, the client may request a refund of the money in proportion to what that specific work is worth and this not being related to the results of the campaigns.

Both parties must notify this decision via email.

14. Service renewal.

According to the results reports, you can choose whether to continue with us or terminate the service. If you continue, then you must buy the service in question again. Regarding the website, these include hosting and domain, which must be renewed every year. The renewal can be with any company.

15. Technical support

After delivering the website, the respective company will be in charge of its own website. In case you need support, maintenance, modifications from neuromarketing and technology, then you must pay separately for these services.

In the case of other services, everything is done through monthly payments.

16. Third parties

We are not responsible for conflicts with third-party companies with which we work on your Email, AdWords, Social networks, web pages, photo services, among other services, whether for charges, restrictions, changes in policies, delays in procedures, and more, which are things that are beyond our will and are part of the decisions of these companies.

The third-party services we work with must be contracted and paid for by you, we act as facilitators and administrators of these tools.

17. Privacy

All information provided by you will be handled privately, and at no time will we sell it to third parties. Please read more in our data protection policies.

All creations made in advertising campaigns, and published in different media, may be used as your company deems appropriate. Regarding the strategies that are managed in these campaigns and the configurations made in AdWords and Analytics accounts, these will remain with us as a way to protect our intellectual property.

Likewise, you must keep private the information provided by email or found in our client area.

18. Compromise

In case of controversy and before resorting to competent courts, or making scandals, it is a commitment of both parties to try to resolve such controversy through a meeting. A record of this event will be made by email.

In case these service conditions are updated, you will be notified by email. Therefore, we recommend that you keep a printed copy of this document.
